Service scope will be clearly defined in your agreement or proposal.

2. User Responsibilities

By using our services, you agree to:

  • Provide accurate information and product requirements
  • Maintain communication for order updates
  • Follow all legal regulations for importing goods into your country
  • Make timely payments as per agreed terms

We are not responsible for incorrect details submitted by the user.

3. Pricing & Payment

  • Pricing differs by service type (monthly agreement or commission-based).
  • Final pricing will be confirmed in writing before project start.
  • Invoices must be paid on time to avoid delays.
  • No work begins without advance confirmation.

4. Supplier & Order Responsibility

ImportCare acts as your representative, not the manufacturer.

  •  We help you:
  • Identify suppliers
  • Verify quality
  • Communicate requirements
  • Coordinate production

However:

  • Final production responsibility lies with the supplier/manufacturer.
  • ImportCare is not liable for factory delays, production defects, or shipment issues beyond our control.

5. Limitation of Liability

To the fullest extent permitted by law:

  • We are not responsible for loss of profit, delays, damages from third parties, or shipment failures.
  • ImportCare provides support and coordination but does not guarantee supplier performance.

6. Intellectual Property

All website content, text, images, and branding belong to ImportCare. You may not copy, reproduce, or distribute it without consent.

7. Prohibited Activities

Users may not:

  • Engage in unlawful activities using our services
  • Misuse website content
  • Attempt to harm our systems
  • Misrepresent their identity or business

8. Termination

We may suspend or terminate services if:

  • Payments are not made
  • User violates terms
  • Fraud or misuse is detected

Users can cancel services by written notice as per agreement policy.

9. Third-Party Links

10. Governing Law

These Terms & Conditions are governed by the laws of India. Any disputes will be resolved in competent courts located in India.

(B) Refund & Cancellation Policy

This policy explains how refunds and cancellations work for ImportCare services.

1. Service Nature

ImportCare provides sourcing, supplier negotiation, inspections, and representation services. These are time-based, effort-driven services — not physical products.

2. Cancellation Policy
2.1 Monthly Agreement Services

  • Can be canceled with a 30-day written notice.
  • Services already delivered during the notice period are non-refundable.

2.2 Commission-Based Services

  • Can be canceled before order confirmation.
  • Once a supplier is locked and order coordination begins, cancellation fees may apply based on work completed.

3. Refund Policy

Refunds apply only in the following cases:

3.1 Monthly Agreement

  • No refunds for the current billing month after work has started.
  • Partial refunds are not provided for unused days.

3.2 Commission-Based

Refunds may be considered only if:

  • No suppliers were provided
  • No sourcing work has started

Once sourcing, verification, or negotiation tasks are done, refunds cannot be issued.

4. Non-Refundable Circumstances

Refunds are not provided for:

  • Change of mind after work begins
  • Supplier delays or manufacturing issues (supplier’s responsibility)
  • Shipment delays or customs issues
  • User’s failure to provide required information
  • Miscommunication caused by incomplete instructions
5. Quality & Supplier Performance

ImportCare ensures:

  • Due diligence
  • Supplier checks
  • Coordination
  • Quality control support

However, ImportCare does not guarantee supplier performance or production outcomes. Refunds cannot be issued for factory-side issues.
